You Have the Ability to Opt-Out of Any Promotion At Any Time. Merchants may run promotions or contests that require you to take an action in order to receive a reward. This data is provided to the advertiser and you will always have the option to not participate. You may stop receiving SMS messages from the Services generally by replying STOP in response to any received SMS from the program. You may also opt-out of receiving SMS messages by emailing support@streamwerksmedia.com. If you opt-out of receiving SMS messages, you may not be able to use certain Services.

This Privacy Policy does not apply to any Personal Data collected by Streamwerks Media other than Personal Data collected through the Services. This Privacy Policy shall not apply to any unsolicited information you provide to Streamwerks Media through the Services or any other means. This includes, but is not limited to, information posted to any public areas of the Services, such as public forums (collectively, “Public Areas”), any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, “Unsolicited Information”). All Unsolicited Information shall be deemed to be non-confidential and Streamwerks Media shall be free to reproduce, use, disclose, distribute and exploit such Unsolicited Information without limitation or attribution.

Children: You must be 13 years of age in order to opt-in to merchant promotions and use certain Streamwerks Media services.  Streamwerks Media does not knowingly collect Personal Data from children under the age of 13. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data on the Services without their permission. Information We Collect, How We Protect It, and How We Use It:  When you interact with us through Streamwerks Media Products or Services, we collect Personal Data from you when you voluntarily provide information such as when you register for access to the Services, opt-in by texting a keyword to one of our shortcodes or 1-800 numbers, use certain Services, contact us with inquiries, add personal information to your mobile wallet or account, or respond to one of our surveys or certain types of promotions. If you make any information available through your public profile within your mobile wallet or account, it will be made available to members of the Streamwerks Media merchant community, but will not be displayed publicly as part of any profile.

By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Policy. If you provide Personal Data, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of Streamwerks Media and the authorized third parties referred to herein located in the United States. You can use our services without providing any Personal Data, other than your mobile number. If you choose not to provide any Personal Data, you may not be able to use certain Services or receive certain type of promotions.

When you interact with Streamwerks Media through the Services, we also receive and store certain personally non-identifiable information. Non-Identifiable or Aggregated Data, which is collected passively using various technologies, cannot presently be used to specifically identify you. Streamwerks Media may store such information itself or such information may be included in databases owned and maintained by Streamwerks Media affiliates, agents or service providers. We may use such information and pool it with other information to track, for example, the total number of visitors or users of the Services, the number of visitors to each page of our website, the domain names of our visitors' Internet service providers, and how our users use and interact with the Service. Streamwerks Media may conduct research on its customer demographics, interests and behavior based on the Personal Data and other information provided to us. Also, if you provide Personal Data in order to obtain access to the Streamwerks Media Services, we will use your Personal Data to provide you with access to such services and to monitor your use of such services. Streamwerks Media and its subsidiaries and affiliates (the “Related Companies”) may also use your Personal Data and other personally non-identifiable information collected through the Services to help us improve the content and functionality of the Services, to better understand our users, and to improve the Streamwerks Media Services. Streamwerks Media and its Related Companies may use this information to contact you in the future via text and/or email to tell you about services we believe will be of interest to you. If we do so, each communication we send you will contain instructions permitting you to "opt-out" of receiving future communications. If at any time you want to discontinue receiving communications or you may unsubscribe to any email you receive and your name deleted from our mailing lists. You may also discontinue receiving (opt-out) of any text message or coupon promotions delivered to your mobile phone by replying STOP and your name, mobile number and information will be deleted from our mobile platform.  

If Streamwerks Media intends on using any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time at which the Personal Data is collected.

Disclosure of Your Personal Data and Other Information: Streamwerks Media does not sell your information. However, there are certain circumstances in which we may share your Personal Data with certain third parties without further notice to you, as set forth below:

Merchant Loyalty Rewards, Coupons, Promotions: To the extent you have obtained or redeemed a reward offered by a merchant, added a merchant reward to your wallet or account, or otherwise participated in any other activity sponsored or offered through the Service on behalf of merchant, we may provide merchants with your Personal Data (a) in order for the merchant to redeem and validate your reward, send you customized offers, troubleshoot redemption, combat fraud and otherwise communicate with you, (b) as part of legal proceedings affecting Streamwerks Media and the merchant, or (c) to facilitate a direct relationship between you and the merchant.

Normal Course of Business:  As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.  We may also share your Personal Data with our Related Companies for purposes consistent with this Privacy Policy. Streamwerks Media  also sometimes hires or enters into agreements with other companies to perform certain business-related functions including maintaining databases, sending emails and SMS messages, offering and developing new product features and maintenance and security. When we engage in these activities we only provide these other companies with information that they need to perform their specific function. We also disclose automatically collected data (card scans, promotional activities, and redemption information) to our Merchants, third-party ad servers and advertisers. These third parties may match this data with information that they have previously collected about you under their own privacy policies, which you should consult on a regular basis.

Streamwerks Media may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation or assist government enforcement agencies, (ii) protect and defend the rights or property of Streamwerks Media, Rewards Providers, or our users, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, (iv) protect against legal liability; (v) protect Rewards Providers from fraudulent, abusive, or unlawful uses; or (vi) protect the security or integrity of the Services.

Links to Other Web Sites: This Privacy Policy applies only to the Services. The Services may contain links to other web sites not operated or controlled by Streamwerks Media (the “Third Party Sites”). The policies and procedures we described here do not apply to the Third Party Sites. The links from the Services do not imply that Streamwerks Media endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.

Integration of Social Media and Other Third Party Services: Some Streamwerks Media products allow you to enable various online third party services, such as social media and social networking services (“Third Party Services”), to be directly integrated into your Streamwerks Media experience. You will need to provide us your username and password for the relevant Third Party Services. By enabling such Third Party Services, you are allowing us to pass your log-in information to these service providers for this purpose. When you add a Third Party Service account to the Service, we will collect your login information and other relevant information necessary to enable the Service to access that Third Party Service and your data contained within that Third Party Service. However, please remember that the manner in which Third Party Services use, store and disclose your information is governed solely by the policies of such third parties, and Streamwerks Media shall have no liability or responsibility for the privacy practices or other actions of any Third Party Service that may be enabled within the Service.

Security: Streamwerks Media takes reasonable steps to protect the Personal Data provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Terms of Service and Conditions of Use: Your access to and use of this Services is subject to Streamwerks Media’s Terms of Use located at the bottom of our websites.
